Frequently asked questions
Is crypto-to-crypto swapping taxed in India?
Yes. Swapping one crypto for another is treated as a transfer, so any gain on the coin you gave up is taxed at 30% plus cess, and TDS can apply.
Can I claim the 1% TDS back?
TDS deducted on your crypto sales is credited against your total tax when you file your return. If more TDS was deducted than the tax you owe, the excess can be refunded.
Are exchange fees deductible?
No. Only the cost of acquiring the crypto is deductible. Trading fees, gas fees and other expenses can't be subtracted from your gain.
Can I set off crypto losses?
No. A loss on one crypto asset can't be set off against gains on another asset or against any other income, and it can't be carried forward to later years.
When does 1% TDS apply?
TDS applies when your total crypto sales in a year exceed ₹10,000, or ₹50,000 for specified persons such as individuals without business income above the audit limit.
Which ITR form do I use for crypto?
Crypto gains are reported in the Virtual Digital Assets schedule (Schedule VDA). Individuals usually file ITR-2, or ITR-3 if they have business income. Check with a chartered accountant for your situation.
